Locate the record of your arrest or conviction. If you do not have it, request a copy from the New Jersey State Police. Complete four forms (the petition for expungement, request for hearing, expungement order, and cover letter) and file them with the court, along with a $52.50 fee and two self-addressed envelopes.
Record Removal Some agencies move faster than others. The State Police can take around 3-6 months to fully process expungements in their system. So realistically, youre looking at 9-12 months from the time you file your petition until government agencies fully clear your records.
Under N.J.S.A. 2C:52-7, a person who has committed only one (or no) indictable offense during the course of his entire life will be eligible for an expungement. In other words, someone who was convicted of two or more indictable offenses cannot seek an expungement except under very specific conditions.
Your expungements may also require your attendance at a hearing. If you have the patience and ability to read through the expungement laws and statutory requirements and you do not mind representing yourself at court hearings, then you may be able to handle your New Jersey expungement on your own.
Some of the most common criminal convictions, such as drug possession, simple assault, and illegal possession of weapons, can eventually being removed from your record. Even convictions for vehicular homicide become eligible for expungement after enough time goes by.
Do you need a lawyer to expunge your record? Nope. Most people can file and successfully process their own Texas expungement without an attorney.
The filing fee for an expungement petition is $75. Other costs associated with this method of filing will include photocopying documents, mailing the documents using certified mail, and the purchase of stamps and envelopes. The total cost would be about $200.
On the other hand, if your record is expunged, it is forgotten for most purposes and likely sealed from public view. Receiving a pardon frees you from the conditions of your sentence and restores your civil rights (such as the right to vote or sit on a jury). But it does not clear your record.
