How Much Will It Cost to Expunge My Criminal Record in Texas? As a general rule, it costs more to expunge a felony than a misdemeanor. The expungement of a felony will customarily cost a minimum of $1,000, but may cost upwards of $2,500 or even more. Misdemeanors can usually be expunged for $1,000 or less.
With limited exceptions, a person cannot get a criminal record expunged if they were convicted of a felony, one of the many consequences of a felony conviction. Most offenses that involve children, sexual assault, and violent acts such as criminal assault, are not eligible for record sealing in Texas.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
In general, expunged criminal records do not show up on background checks. Usually, if people expunge their records, they do not have to disclose them when asked. As a result, this helps people find a job more easily.
In Texas, you may qualify for an expungement if: You were acquitted at trial; You were pardoned from a criminal conviction based on actual innocence; The charges did not result in a final conviction; You were pardoned by the President of the United States or Governor of Texas;
Other charges are deemed so severe, they cannot even be sealed, such as felony domestic violence, child abuse, or sexual misconduct. However, you may be able to get a felony arrest expunged if the case was dismissed. Other examples of felony cases that you cannot expunge are: First-degree felony for aggravated battery.
