In the FBIs Uniform Crime Reporting (UCR) Program, law enforcement agencies can clear, or close, offenses in one of two ways: by arrest or by exceptional means. Although an agency may administratively close a case, that does not necessarily mean that the agency can clear the offense for UCR purposes.
To expunge means to destroy, obliterate, or strike out records or information in files, computers, and other depositories. A well-known example of this is the expungement of criminal records.
An expungement order means a court removes an arrest or conviction from a persons court record for most purposes. After the expungement process is complete, you are not legally required to disclose the incident. In limited situations, you might be expected to disclose an expungement.
Nearly every state has existing laws that allow people to petition to seal or clear their criminal record after a certain amount of time. Unfortunately, the petition process to clear criminal records in most states is complicated and burdensomeand often costly.
The Court charges a fee for filing each dismissal/expungement petition. The fee is currently $120 for each felony case and $60 for each misdemeanor case. There is no filing fee for dismissing/expunging infractions.
