Pursuant to the South Carolina Code of Laws, a criminal record may only be expunged through an application to the court, which must be signed by a judge. An individual should contact the solicitors office in the area where the charge originated to seek assistance and obtain an application, which does require a fee.
The Court charges a fee for filing each dismissal/expungement petition. The fee is currently $120 for each felony case and $60 for each misdemeanor case. There is no filing fee for dismissing/expunging infractions.
Otherwise, there are several administrative costs for expungement in South Carolina including a non-refundable fee of $250 to the solicitors office, a non-refundable fee of $25 to SLED, and a $35 fee to the county clerk of court.
You will need to enclose a copy of your Photo ID and a certified check or money order in the amount of $20.00, made payable to Commonwealth of Pennsylvania. For any case that was disposed of at the Magisterial District Court, use the Petition for Expungement Pursuant to Pa. R. Crim.
There are fees associated with an expungement, except when charges are dismissed or nol prossed (not prosecuted), or when a person is found not guilty. In those cases, the expungement is FREE, unless charges are dismissed in plea negotiations.
How long does the expungement process take? The process may take up to six (6) months from the date the Expungement Office receives the completed Expungement Application. You will NOT receive a confirmation of receipt of your Expungement Application.
Traffic offenses, motor vehicle offenses, and wildlife and game offenses cannot be expunged. First Offense Conviction for Failure to Stop When Signaled by a Law Enforcement Vehicle. This conviction is eligible when: It is a first offense.
First-offense magistrate or municipal court convictions with a maximum potential penalty of up to 30 days can be expunged in SC after three years under SC Code 22-5-910. This does not include traffic offenses like speeding or driving under suspension.
