A: For any license or credential given by an agency in CA, any livescan will pull up a persons entire criminal history as it is stored in the DOJ repository. However, agencies prefer to see cases that have been expunged or sealed for dozens of reasons.
While most convictions cannot be removed from a persons record, Texas law does allow individuals to remove information about an arrest, charge, or conviction from their permanent records in certain circum- stances. This is called an expunction.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Expunge is a true delete. It completely removes the data from the application and cannot be recovered. An expunged record is still captured in the audit trail/record history.
When your conviction is dismissed, it is not removed from your criminal record held by the California Department of Justice, but the record will show that your conviction was dismissed. Many public employers will likely be able to see your conviction, but will also see that it has been expunged.
The easiest way to check if your criminal record has been expunged is to visit the court where your case was handled and ask to see the records. If the court tells you they dont have your records, it means they were expunged.
How long does a California Expungement take? Generally speaking, you can count on your expungement taking in the neighborhood of 90 to 120 days, but certain courts or older cases can take longer. Several factors impact the length of time an expungement takes to go through the court system.
An expunged arrest is removed completely from the public record. Sealing court records generally only applies to crimes committed by juveniles. The arrest and conviction will remain on the persons record but can only be seen by court order. Sealed records should not turn up in a criminal background check.
