To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Under N.J.S.A. 2C:52-7, a person who has committed only one (or no) indictable offense during the course of his entire life will be eligible for an expungement. In other words, someone who was convicted of two or more indictable offenses cannot seek an expungement except under very specific conditions.
You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
Most common expungable convictions: 5 Year. Public intoxication. Possession/administration of CDS. Drug Paraphernalia. 7 Year. 2nd Degree Assault. CDS with Intent to Distribute. 3rd Degree Burglary. 10 Year. Felony theft. Burglary 1st and 2nd Degree. Attempt, conspiracy, or solicitation of any of these listed offenses.
The criminal charges were expunged [=deleted, erased] from his record. They hoped to expunge [=erase] the memory of that tragic event.
The filing fee for an expungement petition is $75. Other costs associated with this method of filing will include photocopying documents, mailing the documents using certified mail, and the purchase of stamps and envelopes. The total cost would be about $200.
If your arrest occurred on or after July 1, 2013, docHub out directly to the prosecuting attorneys office of the county where your arrest took place.
