Domestic violence-related offenses and driving offenses, such as DUI, do not qualify for mandatory expungement. Most adult felony convictions, and certain adult misdemeanor convictions are not eligible for mandatory expungement.
Note that expungements are not available for DUI-related arrests.
What does that do? Delaware passed The Clean Slate Act, which will take effect in 2024 and creates a process for automatically expunging some records. This is good news, but it is far from perfect. The automatic expungement will not apply to all criminal records that could be eligible for expungement.
How Long Does a DUI Stay on Your Record in Delaware? In Delaware, DUI offenses stay on the offenders record for five (5) to ten (10) years. Interested parties may petition the court to expunge or seal eligible records after this time. Records that are considered public may be accessible from some third-party websites.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Under the Adult Expungement Reform Act, if a person was convicted of a one or more criminal offenses, including most felony offenses, and is, thereafter, unconditionally pardoned by the Governor, then they may apply to the Court for a discretionary expungement of their arrest and prior conviction records.
If the case was terminated in your favor, such as acquittal, nolle prosequi, dismissed, etc., there is no wait. If you were convicted of one or more violations in the same case, you must wait three years. If you were convicted of one or more misdemeanors in the same case, you must wait five years.
