Kansas offers expungement of some adult criminal records. In Kansas, an expunged record is hidden from public view, not destroyed. Private employers, landlords, and banks cannot see an expunged record. Only authorized agencies and courts have access to expunged information.
Expungement in Kansas also does not relieve you of any requirement you have to register as an offender if you have been ordered to do so. If the expungement is for a felony, there is no guarantee that your right to purchase firearms will be restored due to restrictive federal and state laws.
By order of the Kansas Supreme Court, the docket fee for an expungement is $195. This fee will apply for each case record for which you are seeking expungement. There is no filing fee for adult cases that were dismissed, no charged, or that had a not guilty disposition.
Traffic convictions CANNOT be expunged (with the exception of a 1st offense failure to stop for a blue light). Fish and wildlife convictions CANNOT be expunged. Convictions for felonies and heinous crimes are not automatically qualified for expungement.
In the cases of a conviction of those minor crimes, you can apply for an expungement three years after your sentence has been complete or you have been taken off of any form of parole. With the more serious Class A, B or C felonies, you will have to wait five years before filing.
Your criminal conviction can be expunged if the required amount of time has passed and you have not been convicted of a felony in the past 2 years. Other felonies and motor vehicle offenses, such as driving while suspended, can be expunged 5 years after the completion of the sentence.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Misdemeanor Offenses: Convictions for misdemeanors that carry a maximum sentence of 30 days and/or $1000 fine may be eligible for an expungement. You must wait three years and have no other convictions in those three years before applying for the expungement/five years if the conviction is for Domestic Violence.
