Summary convictions will be sealed after 5 years. Eligible misdemeanor convictions can sealed after 7 years without another misdemeanor or felony conviction. Eligible felony convictions can sealed after 10 years without another misdemeanor or felony conviction.
In Pennsylvania, the expungement of a record means that the record is destroyed and removed from government databases. With sealing, technically called an Order for Limited Access in Pennsylvania, the record still exists but it is not publicly accessible.
If a withhold of adjudication was entered, expungement is possible once the case has been sealed and no further criminal action has been reported for ten years. In order to qualify to seal or expunge of criminal records, Florida residents must not have any guilty judgments against them on their record.
The Clean Slate Act​ The Clean Slate Act requires automatic expungement of certain records from a persons BCA criminal history, replacing the current requirement that the person petition the court for an order expunging the record.
What kinds of charges are eligible for expungement in PA? All criminal charges that did not result in a conviction are eligible for expungement in Pennsylvania. For example, charges that are not guilty, withdrawn, dismissed, or nolle prossed are eligible for expungement.
Most drug and property felony convictions can be sealed after 10 years or longer without a felony or misdemeanor conviction. The waiting period for misdemeanor sealing is reduced to 7 years. Makes clear that sealed and expunged records cannot be used to deny opportunities in employment, housing, or education.
Pennsylvania has expungement laws that help people who received a summary offense, Accelerated Rehabilitative Disposition (ARD) or had an arrest that did not lead to a conviction. Expungement usually takes about 4 to 6 months. Attorneys typically charge between $700 to to $1000 to expunge your record.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
