A DUI conviction may never be erased from your permanent criminal record. Florida DUI penalties provide that anyone convicted of DUI receive a mandatory adjudication of guilt. In Florida, once you have been adjudicated guilty (formal conviction of a crime) you are ineligible to seal or expunge your record.
In the state of Florida, a DUI conviction remains permanently on your criminal record, even if it is a misdemeanor. Once you have a DUI conviction, you cannot hide or remove the conviction from your record.
Some felonies can be expunged. However, some crimes are ineligible for expungement, including sex crimes, violent crimes, crimes resulting in bodily injury to another person, homicide, and human trafficking. For most felonies, an individual must wait eight years after conviction to request an expungement.
This requires substantial evidence. If there is insufficient evidence to prove your guilt beyond a reasonable doubt, the prosecutor may drop the charges. Offenses that could not be expunged or set-aside included offenses like murder, criminal sexual conduct or any traffic offense.
Remember, while many felonies might be eligible, certain serious crimes, like murder, sexual battery, and child abuse, cannot be expunged.
