(1) ELIGIBILITY. A person is eligible to petition a court to expunge a criminal history record if: (a) An indictment, information, or other charging document was not filed or issued in the case giving rise to the criminal history record.
On the other hand, if your record is expunged, it is forgotten for most purposes and likely sealed from public view. Receiving a pardon frees you from the conditions of your sentence and restores your civil rights (such as the right to vote or sit on a jury). But it does not clear your record.
Such an offense may no longer be visible to a potential employer, but the Government of Canada gets their information straight from the FBIs National Crime Information Center (NCIC) which still shows an arrest record or criminal conviction even after an expungement.
Record Expungement Versus Record Suspension A record suspension does not erase a criminal record but seals it from public view, making it invisible during routine background checks. On the other hand, expungement goes a step further by entirely removing the record from federal databases as well.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Record suspensions are commonly referred to as record expungements or pardons. A record suspension keeps the judicial record of your conviction(s) separate and apart from other criminal records the police have on file.
If an application for expungement is approved, federal records of that conviction will be destroyed or removed. Unlike a record suspension/pardon, expungement is also available to those both living and deceased.
