In California, when your record is expunged, the court clerk informs the FBI and the DOJ to update their records to show that your case has been dismissed. Note that private companies that do background checks, are not notified of the dismissal.
Not all criminal records can be restricted in the state of Georgia. Generally, arrest and court records where the charges were dismissed are eligible for expungement.
No, records restricted following state laws (O. C. G. A. 35337) do not show up in background checks. However, records under time-expired restrictions may be provided to the Federal Bureau of Investigation (F. B. I.) or other states for non-criminal justice uses.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
There is a new law in California that went into effect in 2023 called the California Clean Slate Act (SB 731). Under the Clean Slate Act, authorities will automatically expunge or dismiss certain arrests and criminal convictions.
Before this new law, almost all convictions stayed on your record for life. As of 2021, you can now petition the court to restrict and seal (expunge) certain convictions from your record. Many pardoned felonies are included.
If your arrest was after July 1, 2013, you will need to contact the prosecutor in your case to inform you about expunging your record. The prosecutor will provide you with a form and direct you thereafter. This form may cost as much as $50.
If your arrest occurred on or after July 1, 2013, docHub out directly to the prosecuting attorneys office of the county where your arrest took place.
