How Expungement Works. Associated persons may seek to remove, or expunge, customer dispute information from CRD/BrokerCheck. FINRA Rules 12805 and 13805 specify a narrow set of circumstances in which expungement of customer dispute information from CRD is appropriate.
FINRA conducts thorough background checks that cover criminal records, civil judgments, liens, bankruptcies, and business records. However, expunged criminal cases do not appear in these background checks.
Under FINRA Rule 2080, members and associated persons seeking to expunge customer dispute information from CRD must obtain an order from a court of competent jurisdiction directing such expungement or confirming an arbitration award containing expungement relief.
