There is no charge to expunge a case with a disposition of acquittal, dismissal, probation before judgment (PBJ), nolle prosequi, stet, or not criminally responsible. Form CC-DC-CR-072B. The filing fee is $30 for eligible guilty dispositions and is nonrefundable, even if denied.
How long does the expungement process take in NC? Regardless of the charge, the expungement process typically takes between 9 12 months in North Carolina.
There is generally a $175 filing fee to petition for expunction. A few expunction statutes do not require a fee, like expunction of charges that were dismissed or ended in a not guilty verdict, unless the dismissal was based on the completion of a diversion program or deferred prosecution agreement.
Who Can Access Expunged Files? Its important to remember that an expunged record means that your criminal history and prior convictions are sealed, not erased. Police, FBI, immigration officers and other public officials may still see sealed court files when needed.
Do you need a lawyer to expunge your record? Nope. Most people can file and successfully process their own Texas expungement without an attorney.
In California, when your record is expunged, the court clerk informs the FBI and the DOJ to update their records to show that your case has been dismissed. Note that private companies that do background checks, are not notified of the dismissal.

You can also call the Legal Aid Helpline directly at 866-219-5262, because Legal Aid assists with some expungement cases if you qualify for additional services.
Other Important Changes to Expungements in North Carolina Now: Misdemeanor convictions qualify for an expungement after five years instead of 15. Before: To expunge a felony conviction, you needed to wait 15 years. Now: Felony convictions qualify for an expungement after 10 years instead of 15.
