California Penal Code Section 1203.4 Expungement A California expungement of criminal records under Penal Code Section 1203.4 is an option for defendants convicted of either misdemeanors or felonies that have successfully completed probation and not served time in state prison.
Thats no longer the case: Under Senate Bill 731, which went into effect in mid-2023, Californians with most kinds of felony convictions, including violent crimes, can ask for their records to be cleared. Sex offenses are the primary exception.
The applicant must complete a Petition for Dismissal form for each case separately and submit it to the Superior Court where the conviction occurred for review and decision by the court. Any supporting documents to show why the court should grant the dismissal/expungement must be filed with the Petition.
An expungement is a form of post-conviction relief authorized by California Penal Code 1203.4 PC.
What is the Clean Slate Act AB 1076, or penal code 1076? Californias Clean Slate Act, or AB 1076 or penal code 1076, automatically seals some arrest records and dismisses some criminal convictions. The law, signed by Governor Gavin Newsom in October 2019, started on Jan 1, 2021.
Generally, 1203.4 is for people who obtained a probationary sentence for a felony or a misdemeanor. By contrast, 1203.4a is for people who did not serve any probation for a misdemeanor or an infraction.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
What fees do I pay for an expungement? You must pay a $250.00 administrative fee to the Solicitors office, a $25.00 fee to the South Carolina Law Enforcement Division (SLED), and $35.00 filing fee to the Clerk of Court. You pay the fees with separate money orders when you apply to your Solicitors office.
