Most attorneys charge $2,000 to $5,000 for these services, and they often take more than a year to complete. The best way to see what you are eligible for is to take our free online eligibility test. Only in very limited circumstances does the state of New York provide for expungement of someones criminal record.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
Under the Clean Slate Act, New Yorkers will be eligible to have conviction records automatically sealed 3 years from sentencing for misdemeanors and 8 years from sentencing for felonies, not including time incarcerated.
Once a conviction is sealed, your conviction will not be available to public or private who perform employment-related criminal background checks. The exceptions to this rule are if you are applying for a job as a police officer or peace officer, or if you are applying to join the military.
You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
People are eligible if they have been crime-free for at least 10 years since their conviction and/or release and have only two (2) convictions on their criminal record. If they have more than two (2) convictions, they may still be eligible if the convictions are related to the same one or two incidents.
2) expungement later. THERES NO EXPUNGEMENT OF AN OWI DUI. If a person is questioning whether they should hire an attorney, or just go for an expungement of a drunken driving offense, the answer is quite simple: there is no expungement of an OWI available under Wisconsin law.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
