Certain felony convictions may be expunged if it has been 10 years since the sentence/probation period ended, and there are no subsequent convictions or pending charges. Convictions for crimes of violence, domestic abuse battery, crimes involving minors and certain drug offences cannot be expunged.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Under most circumstances, your felony conviction stays on your record for life. While employers may not ask about convictions beyond a certain period of time and your conviction may not always appear on a general background check, in reality, your conviction is always there. That is unless it is expunged.
DWI and DUI Expungement Details The expungement process may only be used once during a 10 year period with respect to the offense of operating a vehicle while intoxicated. The record will be maintained for 10 years and is kept confidential; however, they may be released to a prosecuting agency, court or the defendant.
Remember, while many felonies might be eligible, certain serious crimes, like murder, sexual battery, and child abuse, cannot be expunged.
(1) ELIGIBILITY. A person is eligible to petition a court to expunge a criminal history record if: (a) An indictment, information, or other charging document was not filed or issued in the case giving rise to the criminal history record.
For most misdemeanors, you need to wait two years after you have completed any sentence, probation or parole before applying for expungement. If the misdemeanor involved controlled substances, you may need to wait five years.
If you want to expunge a conviction, the offense that you were convicted of cannot be any of the following: A violent crime; A sex crime; Distribution of controlled dangerous substances; Misdemeanor domestic abuse battery; Misdemeanor stalking; or. A crime against a minor.
