Criminal records are eligible to be expunged for a wide variety of charges, including: Retail Theft. Criminal Trespass. Unlawful Possession or Consumption of Alcohol by a Minor. Child Endangerment. Driving While License Suspended. Possession of Drug Paraphernalia. Theft. Deceptive Practices.
Having an arrest or conviction on your public record is more than embarrassing; it can affect your employment and housing options unless you are approved for a felony expungement. Since felony convictions stay on your criminal record for life, it is a good idea to do whatever it takes to have them removed legally.
If you file a Motion to Set Aside a conviction, there are associated costs, such as the cost to obtain fingerprints, $50.00 for the Michigan State Police to analyze your fingerprints, court filing fees, and the cost to obtain a certified copy of your conviction. In all, the costs should not exceed $250.00.
A person who has any pending criminal charges is not eligible for expungement. Minor traffic offenses cannot be expunged (except if released without charges). The following court supervision records also cant be expunged: reckless driving (age 25 or older), DUIs, and sexual offenses against a minor.
The cost of expungement in Florida can vary depending on several factors, including the complexity of the case and whether you hire an attorney to assist you. In Florida, it costs a minimum of $995 to get your record expunged but this may change over time.
Offenses that could not be expunged or set-aside included offenses like murder, criminal sexual conduct or any traffic offense.
In the state of Illinois, battery charges may be eligible for expungement, but there are conditions that must be met: The conviction must have occurred more than 5 years ago. You must have been sentenced to court supervision. You have no other convictions on your record.
Once a judge signs an order to expunge or seal, the Clerk of the Circuit Court will remove all records from their system including their public access system so the information does not appear on a background check. A search in the Clerks system will not yield any results as if the case never occurred.
