Missouri law prohibits certain convictions from being expunged, among them many violent crimes such as domestic assault.
This act provides that beginning August 28, 2027, all records and files maintained by any court pertaining to clean slate eligible offenses, which shall be offenses currently eligible for expungement by law, shall become closed records without the filing of a petition, subject to certain requirements as provided in
Before someone can file for an expungement, the individual must have paid off his or her fine, completed his or her probation or parole, and have a three-year clean date to be eligible for a felony offense expungement or have a one-year wait to be eligible for a misdemeanor offense, municipal offense, or infraction
In Missouri, a felony remains on your criminal record indefinitely unless you go through the expungement process.
You can apply for expungement of a conviction only after you have completed your sentence. You must count from whatever date is the most recent, such as the date of conviction, completion of sentence, completion of probation or parole, or final payment of restitution. Then you must wait for several years.
This act provides that a person may petition for expungement of crimes committed as part of the same course of criminal conduct or as part of an extended course of criminal conduct at least 10 years from the date of any sentence imposed under law.
For felonies at least 3 years must have passed since you completed your sentence, and in the past 3 years, you have not been found guilty of any misdemeanor or felony offense(s) (excluding most traffic violations). For misdemeanors and infractions same requirements as felonies, but one-year period instead of three.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
