While an expungement is great, there are certain limitations on it. For example, district attorneys and police academies can see these expunged records. Once a charge is expunged, it comes out of those public terminals fairly quickly. But it can take months up to at least six, eight, even a year before those charges are completely removed from the public and private domains. Even after the expungement has been filed, it may take months for private agencies to update their own records to reflect this expungement. Violent misdemeanors such as child abuse and assault with a deadly weapon are not eligible. Class A felonies, including murder, and felonies requiring sex offender registration, such as sexual battery, incest, and human trafficking, are never eligible for expunction.
Ultimately, the charge or conviction will remain on your record indefinitely unless you successfully go through the expungement process.
In North Carolina, a judge will determine whether it is possible to drop any charges on a simple assault case using three elements. The first one is intent. Intent refers to the nature of the assault and if there were serious threats involved during the assault. The next element is reasonable apprehension.
A petition for expunction should be filed with the clerk of court in the county where you were charged or convicted. What is the process for filing for an expunction? The exact process is slightly different for each expunction statute. The general process is covered on the instruction sheet for each petition.
In North Carolina, the waiting period for expungement has recently changed due to new laws and is only five years for a single misdemeanor conviction or 7 years to expunge multiple misdemeanor convictions.
The petitioner cannot be on probation or parole anywhere, cannot have any arrest warrants, and cannot have any open criminal cases. Specific types of violent crimes are not eligible for expunction. Violent misdemeanors such as child abuse and assault with a deadly weapon are not eligible.
This includes: Felony Murder. Kidnapping. Criminal Sexual Conduct. Prostitution. False Imprisonment. Indecent Exposure. and more.
They can also never be removed from your record, as the expungement statutes expressly state that any conviction where assault is an element of the charge cannot be expunged. While there is no specific charge of domestic assault, similar to other crimes, all assaults can be domestic violence crimes.
