How long does it take to get an expungement? As a general rule, 2 to 4 months, but it can vary. There are certain certified records that must be filed with a petition for expungement. A person is eligible to file if they were convicted of: - a criminal offense that is no longer a crime. - certain nuisance crimes. - cannabis possession under Criminal Law Article 5-601. - specified crimes under Criminal Procedure Article 10-110.
The petitioner cannot be on probation or parole anywhere, cannot have any arrest warrants, and cannot have any open criminal cases. Specific types of violent crimes are not eligible for expunction. Violent misdemeanors such as child abuse and assault with a deadly weapon are not eligible.
