Once a conviction is sealed, your conviction will not be available to public or private who perform employment-related criminal background checks. The exceptions to this rule are if you are applying for a job as a police officer or peace officer, or if you are applying to join the military.
You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
Under the Clean Slate Act, New Yorkers will be eligible to have conviction records automatically sealed 3 years from sentencing for misdemeanors and 8 years from sentencing for felonies, not including time incarcerated.
Under N.J.S.A. 2C:52-7, a person who has committed only one (or no) indictable offense during the course of his entire life will be eligible for an expungement. In other words, someone who was convicted of two or more indictable offenses cannot seek an expungement except under very specific conditions.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
Pardons remove or decrease penalties. Expungement clears a charge from a criminal record. Pardons may cover any charge. Expungement only covers certain types of misdemeanors.
People are eligible if they have been crime-free for at least 10 years since their conviction and/or release and have only two (2) convictions on their criminal record. If they have more than two (2) convictions, they may still be eligible if the convictions are related to the same one or two incidents.
