The Michigan State Polices expungement fingerprint card is for an applicant to submit fingerprints when seeking to set aside a conviction. A Motion to Set Aside Conviction is commonly referred to as an Expungement Motion. The form, a RI-008, is available at any Michigan State Police post or can be accessed online.
In Michigan, you can apply for an expungement only after five years have passed since your conviction, so filing too soon will result in an automatic denial.
Your criminal record may already be expunged, but how would you know? On April 11, 2023, Clean Slate Automatic Expungement arrived in Michigan. This new law clears away old criminal records from people who have remained crime-free for a period of years, opening doors of opportunity in jobs, housing and education.
If you file a Motion to Set Aside a conviction, there are associated costs, such as the cost to obtain fingerprints, $50.00 for the Michigan State Police to analyze your fingerprints, court filing fees, and the cost to obtain a certified copy of your conviction. In all, the costs should not exceed $250.00.
Offenses that could not be expunged or set-aside included offenses like murder, criminal sexual conduct or any traffic offense.
Only certain criminal arrests or convictions, including some misdemeanor crimes and certain non-violent felonies, may be eligible for expungement. Eligibility is dependent on a variety of factors.
Thus, most misdemeanor and felony convictions are eligible for expungement under the new law. However, not everyone qualifies for an expungement. The first step to determining if you qualify for expungement is to check your criminal record. There is no limit to the number of misdemeanor offenses that can be expunged.
Who Is Eligible for Expungement? Under Michigans new clean slate laws, people who have been convicted of up to two felonies and four misdemeanors will automatically have their criminal record expunged.
