Yes, if you are submitting an expungement form for either Driving Under the Influence, Under the Age of Twenty-One conviction, or First-Time Drug Related/Property Offender conviction with the Expungement Application (HCJDC-159(b)).
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
The main exception is that drunk driving offenses (OWI DUI), and any traffic offense resulting in physical harm or injury to a person are excluded. Also, even though you can expunge the conviction from your criminal record, the entry remains on your main driving record.
After the first offense DUI sentence has been completed, you must wait five years to apply for expungement. During the five year probationary period, you must NOT get arrested or convicted of any other crimes.
