In Pennsylvania, the expungement of a record means that the record is destroyed and removed from government databases. With sealing, technically called an Order for Limited Access in Pennsylvania, the record still exists but it is not publicly accessible.
Which is better? To seal an arrest is better than to simply Expunge your record, because an Expungement does not protect you from having to disclose the details of your conviction to any State Licensing Board or Government Job you apply to.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Pennsylvania has expungement laws that help people who received a summary offense, Accelerated Rehabilitative Disposition (ARD) or had an arrest that did not lead to a conviction. Expungement usually takes about 4 to 6 months. Attorneys typically charge between $700 to to $1000 to expunge your record.
Most drug and property felony convictions can be sealed after 10 years or longer without a felony or misdemeanor conviction. The waiting period for misdemeanor sealing is reduced to 7 years.
