Tennessee law explicitly states that domestic assault convictions cant be expunged. This means that even if you fulfill all the other requirements for expungement, the conviction will remain on your record permanently.
Not all charges and convictions can be expunged in Tennessee. Some charges that cannot be expunged include severe felonies, sex crimes, and certain types of DUIs. However, misdemeanors, non-violent felonies, and many drug offenses may be eligible for expungement.
You qualify for expungement if you have all of the following: You must have no other convictions anywhere other than the one to be expunged. You must have completed all terms of imprisonment, probation, or parole. At least five (5) years must have elapsed since the completion of the sentence imposed for the offense.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
In the state of Florida, you typically can only have your case sealed and expunged once in a lifetime. Under Section 943.059, Section 943.0585, or previous versions of those statutes, in Florida. With respect to the relief offered by these statutes, a person may only seal or expunge one arrest record in one proceeding.
A person must pay $100.00 to the court clerk each time he or she files a petition for expungement of a Tennessee conviction. In some circumstances, additional court costs may be required. A person may file a Tennessee expungement petition 5 years after the completion of the sentence for the Tennessee conviction.
Firearms rights may generally be regained by a pardon, judicial certificate of restoration under Tenn. Code Ann. 40-29-105; however, only expungement restores rights where the offense involved violence or drug-trafficking (see below).
The expungement and sealing processes are nearly identical. First, you must file a petition and pay a fee with the circuit clerk in the county in which the arrests occurred or the charges were brought. If you were arrested or charged in multiple counties, then you must file a petition in each of those county.
