Pennsylvania law allows for the expungement of summary offenses IF the person has been free of arrest or prosecution for five years following the conviction for that offense. Basically, if a person has stayed out of trouble for five years, he or she is eligible to have a summary conviction expunged.
Individuals who pled guilty or were found guilty after trial of a summary offense more than five years ago but have not been arrested since. If convicted of the summary offense of underage drinking, one can apply for expungement after they turn twenty-one years old.
When a person wishes to expunge their summary offense, the following must apply to their situation: At least 5 years have passed since their conviction. The defendant has completed their assigned sentencing. In addition to the repayment of fines, all associated court costs have been paid.
Expungement removes arrest or criminal conviction data from your criminal record. You can start the process by filling out Form SP 4-170 Request for Access and Review.
Pennsylvania has expungement laws that help people who received a summary offense, Accelerated Rehabilitative Disposition (ARD) or had an arrest that did not lead to a conviction. Expungement usually takes about 4 to 6 months. Attorneys typically charge between $700 to to $1000 to expunge your record.
In order to expunge summary offenses, a person must petition the court. Nonetheless, certain information related to the crime may still exist within other records. Private background searches may also reveal evidence of minor criminal offenses even if they have been expunged in public records.
Expungement/Limited Access Petitions and Orders are filed with the Clerk of Court Office. There is a $155.00 non-refundable filing fee for expungement petitions filed at existing Court of Common Pleas dockets.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
