When a record is expunged, no onenot even the police or courtshave access to it. After a record has been expunged, it no longer exists.
Expungement completely erases and destroys a record. Sealing (limited access) hides the record so it does not appear on background checks for employment, housing and education purposes.
Pennsylvania employers who partner with a CRA to conduct background checks must comply with the Fair Credit Reporting Act (FCRA). The FCRA restricts non-conviction information reported by a CRA to a 7-year lookback period which includes arrests, civil judgments, tax liens, and most credit report information.
Pennsylvania has expungement laws that help people who received a summary offense, Accelerated Rehabilitative Disposition (ARD) or had an arrest that did not lead to a conviction. Expungement usually takes about 4 to 6 months. Attorneys typically charge between $700 to to $1000 to expunge your record.
On December 14, 2023, Clean Slate Expansion (Act 36) became law in Pennsylvania. Expanding on the original Clean Slate, Pennsylvanians will now be able to seal felonies for the first time, among other important changes to the sealing law. We believe that hundreds of thousands of people will benefit from the new law.
If the court seals your record, it will be automatically expunged 5 years later, or on your 23rd birthday (whichever is first). Remember: your juvenile record will not just go away when you turn a certain age. You will need to ask the court to seal your record.
You are not eligible to get your record closed for serious felonies, violent crimes, sex crimes, intoxication-related crimes, motor-vehicle violations if you hold a commercial-drivers license, and ordinance violations if equivalent to felonies in Missouri.
In 2021, Virginia enacted legislation that allows criminal convictions to be sealed from public view. This is different than expungement because expungement is only for non-convictions (acquittals and dismissed charges).
