There is generally a $175 filing fee to petition for expunction. A few expunction statutes do not require a fee, like expunction of charges that were dismissed or ended in a not guilty verdict, unless the dismissal was based on the completion of a diversion program or deferred prosecution agreement.
The only statutory requirements for expunction eligibility under this category are that 1) you have been arrested and released, 2) the charge, if any, has not resulted in a final conviction and is no longer pending, 3) there was no court-ordered community supervision, unless the offense is a Class C misdemeanor, and 4)
Misdemeanor convictions can now be expunged after 5 years instead of 15. Felony convictions can now be expunged after 10 years instead of 15. There is no more limit on how many dismissals can be expunged. Prosecutors and law enforcement personnel will have access to all records.
The petitioner cannot be on probation or parole anywhere, cannot have any arrest warrants, and cannot have any open criminal cases. Specific types of violent crimes are not eligible for expunction. Violent misdemeanors such as child abuse and assault with a deadly weapon are not eligible.
The NC Second Chance Act includes a provision that allows for offenses (excluding Class A-G felonies) committed at age 16 or 17 in NC before Raise the Age went into effect to be expunged upon completion of your sentence.
Violent misdemeanors (assault with a deadly weapon, child abuse, and others), Class A felonies (murder and others), and felonies requiring sex offender registration (sexual battery, human trafficking, incest, and more), are among those that are never eligible for expunction in North Carolina.
You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
