A: Contact the court that heard the criminal case (circuit or district, in the county where the hearing occurred). Read and complete the expungement paperwork online (this will open an external website) or on paper at the courthouse (any courthouse should have blank forms and explanatory brochures as handouts).
An Expungement is the removal of court and police records from public inspection. This does not include Motor Vehicle Administration records, which may have minor traffic violations, such as a speeding ticket. This process should take no more than 90 days unless there is an objection or an appeal.
File an Expungement or Sealing Petition in Illinois in Person. To file an expungement or sealing petition in person, you must go to the courthouse in the county (or district) that has your records. Hand your petition directly to the circuit court clerk and pay the filing fee.
The filing fee is $30 for eligible guilty dispositions and is nonrefundable, even if denied. The fee is for each case (not for each charge related within a unit of the case). If you cannot afford the fee, you may request that the court waive the filing fee.
There is no charge to expunge a case with a disposition of acquittal, dismissal, probation before judgment (PBJ), nolle prosequi, stet, or not criminally responsible. Form CC-DC-CR-072B. The filing fee is $30 for eligible guilty dispositions and is nonrefundable, even if denied.
Yes, there are certain cases where you generally cannot get records expunged. If you received a PBJ, and you were later convicted of a new crime within 3 years of the PBJ, you cannot get the PBJ case expunged. You cannot file for expungement of any records if you currently have criminal proceedings pending against you.
