In the criminal context, the Supreme Court of Canada has ruled repeatedly that polygraph evidence is inadmissible because it is unreliable, is a form of oath enhancement and the bolstering of credibility, is hearsay, and is good character evidence.
Ethical Issues Polygraph tests are clear invasion into the personal privacy and civil liberties of individuals as several crime suspects or examinees are forced to become the subjects of the tests (Metzinger, 2006). The issue of privacy violation is true in the case of industrial application of the tests as well.
Even the term lie detector, used to refer to polygraph testing, is a misnomer. So-called lie detection involves inferring deception through analysis of physiological responses to a structured, but unstandardized, series of questions.
California Prohibits Admission of Polygraph Tests Because of their suspect reliability, California law does not allow the results of a lie detector test to be admitted as evidence in court.
The test cannot actually test for honesty, however. Instead, it relies on the polygraph operators analysis of the tested persons responses, which can be inaccurate. As such, polygraphs are usually not admissible as evidence in United States courts.
Polygraphs are not admissible in court when either the state does not recognize them as valid exams, when both parties do not stipulate to allow them into evidence in states that do permit them, when the law prohibits their use in certain situations, and/or when a judge refuses their admittance in a specific case.
The Act generally prevents employers engaged in interstate commerce from using lie detector tests either for pre-employment screening or during the course of employment, with certain exemptions. The Act, signed by the President on June 27, 1988, became effective on December 27, 1988.
The Employee Polygraph Protection Act (EPPA) prohibits most private employers from using lie detector tests, either for pre-employment screening or during the course of employment.
