An artist licensing agreement is an where an artist gives a client permission to use their artwork by allowing them to acquire a license for promotional purposes to bolster a product or service.
The copyright owner must enter into a written agreement, specifying the rights being transferred, in order to sell a copyright. The first sale doctrine allows the purchaser of a lawful copy of the artwork to resell, distribute, or publically display that copy without the artists permission.
Unfortunately, using the US Library of Congresss Copyright Office does require a filing fee. The standard filing fee for copyrighting art is $55, but if youre registering only one work as the sole author and claimant, it will cost only $35. You must file individual claims for each artwork you wish to copyright.
Register Your Work Go to the Library of Congress website and click on the electronic Copyright Office (eCO). Fill out the registration form and pay the required fee. Once the registrars office examines your application, they will send you an official certificate of registration.
Exclusivity, in a contract with a client who is requesting a custom piece, prevents the artist from creating and/or selling reproductions of the original work. In other words, you paint a piece, the client pays you, you transfer ownership of the piece to the client, and you cant sell prints of that piece.
Copyright is a form of protection provided by the laws of the United States to the creators of original works of authorship, including literary, dramatic, musical, and artistic works. United States copyright law was last generally revised by the Copyright Act of 1976, codified in Title 17 of the United States Code.
