The patent law provides for the granting of design patents to any person who has invented any new, original and ornamental design for an article of manufacture. A design patent protects only the appearance of the article and not structural or utilitarian features.
THE ISSUE WITH PATENTING YOUR DIGITAL DESIGN For over 25 years, the US Patent Office has allowed for patents on designs that are incorporated into physical displays. However, computer-generated image designs not displayed on a screen are not eligible for design patent protection.
Examples of inventions protected by utility patents include computer software, investment strategy, medical equipment, tools, chemical compositions, genetically altered life forms, and improvements.
