For possession and ownership of rights in the property to transfer from one person to another by way of a gift, the requirement is that there must be an intent to give the property to another person in the present time, there is acceptance of the gift, and there is delivery.
Since a gift deed is to be attested by at least two witnesses, its execution can be said to be proved only when it is proved that the donor has signed the deed of gift or acknowledged his signature to the two witnesses who have attested the same and those witnesses have signed in presence of the donor.
Acceptance of a gift by the donee can be done anytime during the lifetime of the donor. . Section 123 provides that for a gift of immovable property to be valid, the transfer must be effectuated by means of a registered instrument bearing the signature of the donor and attested by at least two witnesses.
Make sure your gift letter includes the following: The donors name. The donors address. The donors phone number. The donors relationship to you. The exact dollar amount of the gift. The date the gift was given.
Both parties should mention all relevant information like address, name, date of birth and signature. A gift deed should have two witnesses and their signatures. A gift deed should be printed on stamp paper once the amount is paid. Once that is done, it should be registered at the registrars or sub-registrars office.
A valid gift requires: (1) a competent donor; (2) an eligible donee; (3) an existing identifiable thing or interest; (4) an intention to donate; (5) delivery; i.e., a transfer of possession to or for the donee and a relinquishment by the donor of ownership, control, and power to revoke (except in gifts mortis causa;
A gift, if valid, is a legally enforceable transfer under general contract law. That means, if a gift meets all of the legal elements of a valid gift, then the gift is enforceable and cannot generally be rescinded and revoked.
