The TMA allows a person to file a petition with the USPTO to request that the Director institute a proceeding to expunge (remove) or reexamine a trademark registration for a trademark that either has never been used in commerce or was not used in commerce before a particular relevant date.
Within two months of the date of the cancellation/expiration notice, the registration owner must file a petition to revive with all the necessary requirements and fees. If more than two months have passed since the USPTO cancellation notice, a trademark owner will need to file a new application for the same mark.
Answer: Yes. If your trademark has been refused by the USPTO, you can still use it in the marketplace. However, if it was refused because the government considered it to be too similar to another mark, then its important to study the judgement carefully before continuing to use the trademark in commerce.
A canceled trademark registration in the United States Patent and Trademark Office (USPTO) is a trademark registration thats no longer valid. Once a registration is canceled, its considered dead and cannot be used by the USPTO to refuse registration of a trademark filed by someone else.
A registrant may file a request to reinstate a cancelled or expired registration if the registrant has proof that a USPTO error caused a registration to be cancelled or expired due to failure to file a 8 affidavit, 71 affidavit, 9 renewal application, or a response to an examining attorneys Office action refusing
A cancellation is the removal of a trademark registration from the register in response to the filing of a cancellation action. The proceedings are initiated when a party with standing files a cancellation action with a designated administrative body within the trademark office or with the responsible court.
You can re register trademark if it has been canceled or marked dead in the USPTO database. Failure to file a renewal application before the expiry of the grace period of six months from the due date results in automatic cancellation of your trademark.
The Loss of Trademark Rights A mark will be considered abandoned if you stop using it for three consecutive years and you have no intent to resume its use. You can also lose a mark through improper licensing or improper assignment.
