The simplest way to make a change to a living trust is with a trust amendment form. A living trust amendment allows you to make changes to an existing trust while keeping the original document active. If you have a joint trust with your spouse, you both must agree to any changes to the trust.
In that ruling, the IRS states that, for assets that were conveyed to an irrevocable grantor trust, there is no step-up in tax basis at the grantors death. For grantors and beneficiaries of an irrevocable trust, the ruling raises onerous tax consequences, which we will discuss below.
If you are looking to remove a beneficiary because of tension between you, i.e., the successor Trustee and a Beneficiary, then in short, No, you cannot remove a Beneficiary.
But assets in an irrevocable trust generally dont get a step up in basis. Instead, the grantors taxable gains are passed on to heirs when the assets are sold. Revocable trusts, like assets held outside a trust, do get a step up in basis so that any gains are based on the assets value when the grantor dies.
There are situations where property may need to be transferred out of a trust during the lifetime of the grantor, such as required or voluntary distributions to beneficiaries, refinancing, or for business purposes. If you need to transfer real property out of a trust, preparation of a Trust Transfer Deed is required.
The surviving spouses A trust property and the property in the QTIP trust is included in the survivors estate. Those assets receive a second step-up in basis when the surviving spouse later dies.
Revocable trusts, like assets held outside a trust, do get a step up in basis so that any gains are based on the assets value when the grantor dies.
Not all assets are eligible to receive a new basis when someone dies. For example, assets owned inside an IRA, 401(k), and other retirement accounts do not receive a step-up. Also, assets owned inside of an S-Corporation or C-Corporation usually do not receive a step-up in basis.
