Digital patent drawing style involves creating illustrations using digital tools and software. These drawings are created electronically, either using graphic design software or dedicated patent drawing software, and are submitted in a digital format along with the patent application.
Patent information Patents are published as part of the terms of granting the patent to the inventor. Subject to limited exceptions reflected in 37 CFR 1.71(d) (e) and 1.84(s), the text and drawings of a patent are typically not subject to copyright restrictions.
The answer is YES! if a petition is granted explaining why the color drawings or photographs are necessary for illustrating the claimed invention. Under 35 U.S.C. 113, the Applicant for a patent must furnish a drawing where necessary for the understanding of the subject matter to be patented.
The drawings in a design patent application may be submitted in black and white or in color. See 37 CFR 1.84(a). Photographs, including photocopies of photographs, are not ordinarily permitted in a design patent application by the U.S. Patent and Trademark Office (USPTO).
However, it is acceptable to use photographs in PVAs and we frequently include marked up drawings as a stand in for formally prepared patent drawings. However, when the provisional patent application is converted to a regular utility patent application, formal drawings must be submitted.
Drawings or Black and White Photographs The drawing disclosure is the most important element of the application. Every design patent application must include either a drawing or a black and white photograph of the claimed design.
Sometimes an inventor needs to provide the U.S. Patent and Trademark Office with drawings of their invention. This can help the examiner understand how the invention works. While some inventors hire professionals to make these drawings, this is not always necessary.
You cannot reapply for the same invention covered in an existing patent. You can, however, file patent applications for improvements and modifications. The extent of your changes will determine whether your new patent application will be considered non-obvious over prior patents.
