The HIPAA Privacy and Security Rules explicitly state that you need a process for erasing the health information in your possession.
Phone calls can comply with HIPAA, but you need to follow certain rules. The most docHub restriction is that you must obtain consent from the patient to call them about a specific issue. These rules apply to landline and cell phone numbers.
HIPAA and Phone Calls to Patients Your phone call can only be for certain things, such as to schedule appointments or to provide lab results. Sharing pre-op instructions or post-op care details is also okay. Another HIPAA-compliant reason for a phone call is to update a patient on their prescriptions.
Condition-based apps A medical app must also be HIPAA liable if it features protected health information, including the patients physical or mental conditions, and healthcare services. This is also true for mobile apps that include past, present, or future payments for the provision of care.
Phones calls are HIPAA compliant provided those making the calls comply with the requirements of the Privacy Rule and the systems used to make the calls comply with or are exempt from the standards and implementation specifications of the Security Rule.
Importantly, using a personal cell phone for patient calls can lead to HIPAA violations if the patients contact details are stored on the phone and it lacks adequate security measures to prevent unauthorized disclosure of ePHI in case the phone is misplaced or stolen.
HIPAA standards apply to all protected health information (PHI), regardless of how it is stored, transmitted or accessed. This includes PHI on mobile devices, such as smartphones and tablets, or electronic PHI.
Phone conversations should be done in a private space away from the hearing of those without a need to know PHI. Do not relay or discuss PHI over the phone unless you confirm the identity of the person to whom you are speaking and their authority to receive the PHI being discussed.
