In a divided co-ownership, each owner owns part of the building, whereas in an undivided co-ownership, all owners are responsible for the entire building together. Purchasing an undivided co-ownership property requires a down payment of at least 20%. This can be a deterrent when the time comes to sell the property.
Settle the matter in court. It is in both co-owners best interests to avoid having to go to court on this matter. However, if no agreement can be made between the two parties, then at this point a court-ordered sale may be the only option to end the co-ownership arrangement and avoid foreclosure on the house.
The Partition Act of Ontario gives some help to co-owners of land who are in conflict. A landowner may petition to the court under the Partition Act to force the sale of his or her land. This right, however, is not absolute. The individual wishing to sell the land must have what is called as a possessory right to it.
A tenancy in common (TIC) is for two or more people with an ownership interest. Tenants may have unequal investment stakes. For example, one owner might have an 80% interest with two co-owners at 10% apiece. Often this corresponds to the financial investment contributed at the original purchase.
Owners are allowed to walk away from the mutual ownership and resort to partition. Partition is the separation and division of a thing held in common among the co-owners or co-heirs. Its objective is to designate to each party their respective shares and their portion of the property owned in common.
Joint ownership of property is simply a case in which two or more people own the same piece of property. Co-owners do not have to be people. They might be other kinds of legal entities, e.g. partnerships or corporations. There are a number of ways in which two or more people can own property together.
Married Couples Unless you and your spouse agree to deal with the home in another way, they can apply to Court for an order for sale. Such an order would not ordinarily be made until a final hearing.
For example, the law presumes that all the co-owners own the property in equal shares, even if your down payments and mortgage payments are unequal. This also implies that all rental income from the property will be shared equally, including profits from the sale of the property.
In a divided co-ownership, each unit is separate from the others and has its own lot/cadastre number. Each co-owner also owns a percentage of common areas proportional to the size of their unit. Divided co-ownership is commonly found in buildings that are duplexes, triplexes or quadruplexes.
Responsible for the sound management of a co-ownership, the manager plans, controls and acts as an advisor. He plays a key role for the syndicate, while usually working under the authority of the Board of Directors. In the same manner, he must also ensure the preservation of the immovable for which he is responsible.
