The new bereavement leave law requires California employers with five or more employees to provide up to five days of unpaid leave to eligible employees for the death of a spouse, child, parent, sibling, grandparent, grandchild, domestic partner, or parent-in-law of the employee.
The five days of bereavement leave do not need to be taken consecutively; they can be intermittent. The employee must complete the bereavement leave within three months of the family members date of death, however.
The time allotted is usually about three days, and you can use it to plan and attend a funeral. Bereavement leave is a type of sick leave meant for grieving a loss. Many employers offer one or two weeks of general paid sick leave per year, which you can use for bereavement.
The California Family Rights Act (CFRA) entitles employees to five days of unpaid bereavement leave. Bereavement leave (sometimes called grievance pay) is time off of work given to eligible employees after the death of a family member or a loved one.
The employer may require that the employee provide documentation of the death of the family member including a death certificate, published obituary, or written verification of death, burial, or memorial services from a mortuary, funeral home, burial society, crematorium, religious institution, or governmental agency.
What is bereavement leave? Bereavement leave is time off granted to an employee in the event that a loved one passes away. The intention is to allow for employees to grieve, attend funeral services or a memorial, or deal with financial and legal matters that may come up after death.
How to ask for bereavement leave Notify your employer as soon as possible. Review your bereavement leave policy. Determine how much time off you want and make a timeline. Make a written request for bereavement leave. Supply relevant forms and documentation. Prepare workplace notes.
