In a month-to-month tenancy, either the tenant or the landlord must give written notice at least one-month in advance. The last day of the tenancy would be the last day of the month. For example, if you plan to end your lease on November 30, you must give your landlord written notice no later than October 31.
Eviction for non-payment of rent If a tenant fails to pay rent, a landlord has two options under the Commercial Tenancies Act. First, the landlord is entitled to re-enter the premises, which usually includes changing the locks and preventing the tenant from using the premises any longer.
If it is a monetary default and the lease does not specify the notice period, the Ontario Commercial Tenancies Act states that if the rent remains unpaid for fifteen days, the landlord may terminate the lease and repossess the premises.
Under the Commercial Tenancies Act, R.S.O. 1990, c. L. 7, commercial landlords can either change the locks and evict the tenant 16 days after the rent was due or seize and sell eligible property inside the commercial property (also referred to as distress).
A break clause in a commercial lease is a contractual provision that allows either the landlord or the tenant to terminate the lease prematurely, usually before the end of the fixed term.
Once your lease expires, a landlord does not have a legal obligation to offer the same space to you unless you have agreed on a renewal formula and have a clause that guarantees the space when your lease expires.
If a tenant wants to terminate their fixed-term lease early, they must pay the rent for the remaining term of the lease agreement unless there is a clause in the lease allowing the tenant to end the lease early. Tenants can sublet or assign the lease unless it is prohibited by the lease.
