How to remove someone from a mortgage (UK) The process of removing yourself or someone else from a joint mortgage is relatively simple and straightforward—as long as everyone is in agreement and wants the same result.
Home refinancing is required to remove your name or the names of your co-signers from a mortgage. So that a new mortgage can take the place of the old one. A name can't just be scratched off mortgage paperwork without a new agreement. Which means refinancing or remortgaging will be required.
If your ex-spouse's name is on the mortgage, her name will remain there until the loan gets paid off or if your lender is willing to release her name from the mortgage. Usually the easiest way to get a person off the mortgage is to refinance the mortgage.
If you don't have surplus capital, you may be able to remortgage to buy your partner out. For instance, if you have £150,000 of equity and your property is worth £250,000, you may be able to remortgage to release some equity. You can then use the funds to buy your partner out and remove them from the mortgage.
Removing a name from a joint mortgage – UK Separation. Divorce. The removal of an investor. A buyout. Handing over the property to a single party. A parent or family member leaving a joint mortgage. Removing a cosigner or co-borrower from a mortgage almost always requires paying off the loan in full or refinancing by getting a new loan in your own name. Under rare circumstances, though, the lender may allow you to take over an existing mortgage from your other signer.
If you need to remove your ex's name from a mortgage without refinancing, you could request a quitclaim deed (a legal document that allows you to transfer interest in real estate as a grantor to a grantee). In this situation, you are asking that your ex-spouse sign the quitclaim deed in front of a notary.
How can I get out of a joint mortgage? Refinancing will pay off the joint mortgage and replace it with a new loan that's in your name only. You'll have to qualify for the new loan using your own income and credit history. You could also sell the home to pay off the joint mortgage.
So in summary, there are three ways to remove your name from the obligation of a mortgage debt. Co-owner refinances after quit claim deed. Sell the property and pay off or settle mortgage debt. Quit claim house to co-owner and file bankruptcy.
You don't need to remortgage to remove an ex from the mortgage as it is possible to do a Transfer of Equity on your existing product and many lenders also allow capital raising on an equity transfer.
