Create a Survivorship Affidavit to Remove a Deceased Owner A survivorship affidavit (sometimes called an affidavit of death or affidavit of continuous marriage) is a legal document used to remove a deceased owner from title to property by recording evidence of the deceased owners death in the land records.
Probate is not required to deal with the property but may be needed if the deceaseds estate warrants it. Much will depend on what the deceased owned and what the beneficiaries intend to do with the property.

HOW DO I RECORD AN AFFIDAVIT? Take a certified copy of the death certificate of the deceased joint tenant and your affidavit to the recorders office in the county where the real property is located. The recorders office also requires a Preliminary Change of Ownership Report (PCOR) when filing the affidavit.
Pennsylvania has adopted the Uniform NonProbate Transfers on Death Act. Assets subject to the Act can be designated as TOD. The Act does not apply to real estate and is often used for bank accounts.
The property will be distributed equally among the remaining owners when one owner dies, so no one person can own a bigger share than another. All owners must have part ownership in the entire property, without limiting any owners access to any part of the property.
An original certificate of death must be submitted in support of the affidavit. When the affidavit is filed and recorded with the county recorder, the successor trustee can sell the property or transfer ownership to the decedents children.
You need to create a trust document (its similar to a will), naming someone to take over as trustee after your death (called a successor trustee). Thenand this is crucialyou must transfer ownership of your property to yourself as the trustee of the trust.
