The settlement agreement is a very comprehensive document that includes all of the terms of your agreement. If youre going through divorce and you dont have children, then its a much more simple document as far as you are just addressing division of assets, division of debt, potentially some alimony. If you have children, its a more complicated document in the sense that in addition to the assets and debt, you also address custody, visitation, and child support. These are in different documents. Theres a parenting plan thats part of the settlement agreement. The parenting plan outlines who has legal custody, meaning who has decision-making regarding the kids. Typically theres joint legal custody where parents have to talk. It defines who has final decision-making authority if the parents cannot come to an agreement on an issue relating to the children, and

A clean break settlement means that the parties to the divorce will have no financial ties once the court order is made and implemented. A clean break order will not include any spousal maintenance. It enables both parties to move forward and be financially independent of one another.
As you can see from this example, the clean break order can be signed and sent to the court on receipt of the decree nisi, which will take approximately two months. Once the clean break order has been signed and issued to the court, you have the confidence that your spouse cant change their mind about the agreement.
Currently there is no time limit for former couples to apply for financial settlements after divorce, meaning that many individuals are at risk of their former spouse lodging a financial claim against them, even decades after the dissolution of marriage.
The court will look at meeting the needs of both parties, including ensuring their housing and income needs are met. If these needs are met from the available assets and there is a surplus, the court may consider the origin of certain assets in deciding how the remainder is divided.
A clean break means ending the financial ties between you and your ex-partner (husband, wife or civil partner) as soon as reasonable after your divorce or dissolution. Where there is a clean break, there will be no spousal maintenance payments.
In the absence of a divorce settlement agreement between the spouses, they retain their own separate estates and there is no sharing of assets on divorce, unless the court granting the decree of divorce orders a redistribution of assets between the parties in terms of Section 7(3) of the Divorce Act.
How much does a clean break order cost? Theres a one-off court fee of 53 to apply for a clean break order. But youll also have to employ a solicitor to draft it for you. Some solicitors charge fixed fees or their services while others charge by the hour.
Cases that require additional negotiation or mediation, in order to docHub a settlement, will typically cost 1,500 to 2,500 (plus vat) to deal with. Cases which have to proceed to Court can cost considerably more to deal with, and in those cases typically costs would be in the region of 4,000 to 8,000 (plus vat).
