Setting up a living trust can be complex and more expensive than a will, but it depends on your unique situation. There are many types of assets that can be included in a living trust in Canada, including bank accounts, real estate, investments, and cryptocurrency.
A revocable living trust allows the person who created the trust to make changes or revoke the trust during their lifetime. This flexibility is useful for those who may expect changes in their estate plan, such as getting married, having children, buying a house, or other lifestyle changes.
The terms of a trust are more legally binding than those of an ordinary will, which can be challenged in a court of law as to whether it fulfills the deceaseds moral obligation. A trust also allows you to avoid the probate process, where the contents of your will are made publicly available.
Often people think that if they settle property on trust, it is still their property. They think that they can still control the property. However, once the settlor has transferred the property, they will no longer have control unless they have reserved the right to control the property.
Disadvantages of a living trust The Income Tax Act states that trusts must dispose of their property 21 years after their creation at the latest meaning that taxes must then be paid. Living trusts should include an ultimate distribution clause that defines when and how the assets will be distributed.
Revocable living trusts have a few key benefits, like avoiding probate, privacy protection and protection in the case of incapacitation. However, revocable living trusts can be expensive, dont have direct tax benefits, and dont protect against creditors.
You can apply for a trust account number by completing Form T3APP, Application for Trust Account Number. Where you send Form T3APP depends on whether the trust is resident in Canada, or is a non-resident trust or deemed resident trust. Refer to page 3 of the Form T3APP for the mailing instruction.
