- Well hey there, this is Seth and in this video Im going to take you through the process of how to put together a warranty deed and a quick claim deed. If you know anything about deeds, those two types of deeds are actually very very different from each other but in terms of the actual information that has to go into the document, its fairly similar across both of them. Creating a deed is actually a fairly simple thing just in terms of what information you have to put in there and how to put it all together so if thats something youre trying to do, I just want to show you the basics of how that is done and Im gonna be showing you on a couple of blank templates that Ive used in the past and I will say that these deed templates Im going to be showing you do not work in all 50 states so dont just take these and start using them whenever you want to. A lot of states have different laws and statutes and just details that need to be baked into deeds based on whatever state your prop

The Special Warranty Deed is similar to the Statutory Warranty Deed. It has the same five covenants of title in addition to fee simple title. However, unlike the Statutory Warranty Deed, the Special Warranty Deed only includes the time period that the seller had the property.
Warranty Deed Rules and Requirements The name and address of the individual who prepared the deed. The name and address of the current owner (also called the grantor) The name and address of the new owner (also called the grantee) Original signature of the grantor (note: the grantee does not need to sign the deed)
A bargain and sale deed indicates that only the seller of a property holds the title and has the right to transfer ownership. This type of deed offers no guarantees for the buyer against liens or other claims to the property, so the buyer could be responsible for these issues if they turn up.
Quitclaim Deeds: Also called a non-warranty deed, a quitclaim deed does not warrant clear title, or guarantee that the grantor has a legal right to transfer the property. It provides the grantee with the least protection of any deed and is often used to fix title errors and transfer property between family members.
A General Warranty Deed provides the greatest assurance and protection to a Grantee (or Buyer). When a General Warranty Deed is used in the sale of a property, the Grantor (or Seller) is providing a warranty of title and conveyance of a property free and clear of any outstanding liens, debts or other encumbrances.
What type of deed offers the grantee the fullest protection against claims to the title? A warranty deed is a legal real estate document and protects the buyer against future claims to the title of the property. Most lenders require a warranty deed for properties they finance.
When you own a home, the deed is the physical document that proves ownership. The title is the concept of legal ownership that the deed grants you. You can think of the deed as the document that transfers, or passes on, the title or the right to ownership. When you buy a home, you need both.
To be valid, each Indiana warranty deed form must meet the requirements of Indiana law. These requirements include valid legal description, statement of consideration, and a description of the manner in which co-owners will hold title, font size and page format requirements, and signature and notarization requirements.
