How to get a severance package when quitting a job Read your employee handbook. Determine if your company has a standard severance package. Talk to former coworkers. A severance agreement should include the following elements: The name of the employer and employee. The effective date of the agreement. The employment period of the outgoing employee. The severance pay amount. Terms of continuation of benefits. Employee waiver of legal claims.
1. What is a severance agreement? A severance agreement is a contract that an employer may ask an employee to sign when they are terminated from a job. Severance pay is often offered in exchange for an employees release of their claims against the employer.
The severance pay offered is typically one to two weeks for every year worked, but it can be more. If the job loss will create an economic hardship, discuss this with your (former) employer. The general practice is to try to get four weeks of severance pay for each year worked.
Those who took it up were offered a lump sum severance equivalent to 22 weeks base pay, one week base salary for every six months of services up to a maximum of 20 weeks, medical insurance for six months and notice period or pay in lieu of it.
For salaried employees: If your salary is $100,000 per year, that is $4,000 for two weeks (given the cap is 25 weeks). If you have been at the company for 10 years, your severance pay would be $40,000 ($4,000 X 10 years). Remember severance pay is not always given; it is dependent on the scenario with your employer.
Theres no standard amount companies provide for severance, and its up to individual organizations to determine how much to give. Many companies calculate severance pay based on how long an individual has been employed with a company, the size of the company and an employees position and rank.
As noted at the start, it is a good idea to ask for severance pay to be paid out as a lump sum so that you can get the most out of the payment, can have finality, and you wont run into a situation where you end up getting less severance pay than initially promised.
