You need pay only the amount of rent the landlord loses because you moved out early. This is because Oregon requires landlords to take reasonable steps to keep their losses to a minimumor to mitigate damages in legal terms.
The landlord can charge the tenant a fee for ending the tenancy early but this can only be for actual and reasonable costs, like the cost to re-advertise the property. - for some fixed-term tenancies, 63 days notice will be required from the landlord, and for other situations, 90 days notice will be required.
There is a one-year statute of limitations on all claims brought under the Oregon Residential Landlord and Tenant Act. To sue your landlord for claims under this Act, you must file those claims in court within one year after you have been damaged.
In cases where a landlord is entitled to give a no-cause eviction after the first year of tenancy, the notice requirement is generally 60 days, 90 days in Portland. A landlord in a month-to-month tenancy may also give you a 30-day eviction notice for cause.
If a landlord wishes to evict a tenant before the tenants lease or rental agreement has expired, the landlord must have legal cause. Legal cause is defined by Oregon law. The most common legal cause for eviction is the tenants failure to pay rent.
In the case of failure to pay rent, the rent must be 7 or more days past due before notice can be given. If the tenant does not comply with the notice within the required time, a complaint can be filed with the court. If the landlord accepts a partial rent payment, the original notice may no longer be effective.
Notices to Terminate the Tenancy To end a month-to-month tenancy during the first year of the tenancy, you must give your tenant a 30-day written notice, unless the rental unit is in the city of Portland, where 90 days notice and payment of relocation costs is required for no-cause terminations.
Except as otherwise provided by statute or agreement, such tenancy may only be terminated by either the landlord or tenant giving the other, at any time during the tenancy, not less than 30 days notice in writing prior to the date designated in the notice for the termination of the tenancy.
