An average fee for the attorney handling a determination of heirship for an estate is $4,000 to $5,000.
The Affidavit of Heirship form you file must contain: The decedents date of death. The names and addresses of all witnesses. The relationships the witnesses had with the deceased. Details of the decedents marital history. Family history listing all the heirs and the percentage of the estate they may inherit.
A fee of $15 for the first page and $4 for each additional page is common. Ask if you can file the two affidavits of heirship as one document. Some counties let you file the two affidavits of heirship as one document if the decedent and property descriptions are the same.
An affidavit of heirship should be signed by two disinterested witnesses. To qualify as a disinterested witness, one must be knowledgeable about the deceased and his or her family history, but cannot benefit financially from the estate.
Note: The affidavit alone does not transfer title, but it is used so that the name on the property records and tax records is changed to the names of the heirs.
An affidavit of heirship must be filed with the real property records in the county where the land is located. Call the county clerk and ask how much their filing fees are. The filing fees vary from county to county.
Who must receive notice that an application to determine heirs has been filed? This notice must be given to each heir aged 12 years or older and the parent, managing conservator, or guardian of each heir younger than 12. See Texas Estates Code 202.051, which also contains proper methods of giving notice.
The document should be signed by an heir and two witnesses who knew the deceased at least ten years in the presence of a notary. They do not need to sign at the same time or location. These witnesses should be knowledgeable about the family history of the deceased.
