Generally, the answer is no. Unless youve signed a waiver or release specifically authorizing your employer to use your image, your boss likely needs your consent before publishing any photos that feature you.
Generally, the author and initial copyright owner of a photograph is the person who shoots or takes the photo.
Photographs taken on personal equipment for purely personal use are exempt from the GDPR requirements. However, any images published or posted on University platforms (e.g. websites, social media channels) must have consent.
If the photo is used in a commercial websitethat is, one sponsored by a business or that sells products or servicesthe unauthorized use of your image would probably violate your right of publicity. The public must be able to identify you in the photograph.
The Image Rights or Use of Likeness clause of an employment agreement stipulates how one party can use the image, name, signature, and other identifying features of the hired party. Some states also recognize a common-law Right of Publicity, an off-shoot of the Right to Privacy.
There are two distinct legal claims that potentially apply to these kinds of unauthorized uses: (1) invasion of privacy through misappropriation of name or likeness (misappropriation); and (2) violation of the right of publicity.
Broadly, taking a photo of an employee for official use counts as personal data under the 1998 Data Protection Act. As a result it cannot be used for any purpose for which it was originally obtained, without the express agreement of the employee preferably in their written and signed employment contract.
When your employer owns the copyrights to the photos, its as if you didnt take them. You have no rights to use them, even for your own portfolio unless your employee gives you a license for such use.
